It might seem as if the pharmaceutical giant Pfizer has quietly become the first to offer the first generic version of GlaxoSmithKline’s Paxil, a drug that has been linked to the deaths of at least three people.
Pfizer’s announcement came on the heels of Pfizer’s latest attempt to get its patent on GlaxoSmithKline’s drug, Paxil, to expire late next year. In May, the company filed a petition with the court challenging Pfizer’s patents on its “newly developed and marketed drug” called Paxil.
The court also granted Pfizer’s motion to invalidate Glaxo’s patent covering a class of drugs called Selective Serotonin Reuptake Inhibitors, including Paxil.
The court also struck off a second patent on Paxil, which will be available only with a generic version, after the patent was struck down by the federal Food and Drug Administration.
As part of the decision, Pfizer, the drugmaker, and other pharmaceutical companies will appeal the decision. The appeal court has yet to rule on whether the court will award damages to the victims of the deaths.
